PURE RACING WEAR (PRW)

1. Seller information

The online store operating under the brand Pure Racing Wear (PRW) (the “Store”) is operated by Kamil Rębisz (the “Seller”).

As of the effective date of these Terms, the Seller operates under non-registered business activity under Polish law. If the Seller registers a business, the Seller’s statutory details will be updated without affecting existing contracts.

2. Definitions
“Customer”, “Consumer”, “Business Customer”, “Product”, “Order”, “Sales Contract”, “Content” – interpreted in line with these Terms and applicable law.
3. Technical requirements and acceptable use

Access to the Store requires an internet-enabled device, an up-to-date browser and a valid e-mail address.

The Customer shall not: post unlawful content, disrupt the Store, attempt unauthorised access, or use the Store in a fraudulent manner.
4. Electronic services
The Store may provide electronic services such as an account, cart, order form, newsletter and reviews. Complaints regarding electronic services may be submitted via e-mail and will be answered within 14 days.
5. Products and brand disclaimers

The Store sells automotive-inspired clothing and accessories.

Unless explicitly stated otherwise, Products are not official merchandise and are not affiliated with any vehicle manufacturer, racing series, teams, tracks or event organisers.

Product descriptions and availability may change.
6. Prices, currencies, taxes, import duties

Prices are displayed in gross amounts in the selected currency.

The Seller may be VAT-exempt under Polish law (where applicable).

International shipments may be subject to import VAT, customs duties and handling fees. Such charges are the Customer’s sole responsibility.

Exchange rate differences may occur depending on the Customer’s bank or payment provider.
7. Order placement and contract formation

Product listings constitute an invitation to treat.

An Order is an offer by the Customer.

A Sales Contract is concluded upon the Seller’s order acceptance/confirmation.

The Seller may refuse/cancel Orders in cases of evident pricing errors, non-payment, suspected fraud or abuse of promotions.
8. Payments
Payments are processed via third-party payment providers (e.g., Stripe/PayPal). The Seller does not store card details.
9. Shipping and delivery

Orders are shipped from Poland.

Delivery times are estimates and may vary due to carrier operations and customs processing.

For Consumers, risk transfers upon receipt of the Product, subject to mandatory consumer law.
10. Promotions and discount codes

The Seller may run promotional campaigns and discount codes with specific terms.

Discount codes: non-cash, limited in time/quantity, generally non-combinable unless stated.

Refunds reflect the amount actually paid after discounts.

Manipulation or abuse of promotions may result in order cancellation and/or account restrictions.
11. Reviews and user content

Customers may post reviews where enabled.

Unlawful, abusive, misleading, advertising or rights-infringing content is prohibited.

The Seller may moderate/remove content that violates the Terms or law.

By submitting content, the Customer grants the Seller a non-exclusive licence to display it for Store operations and communication.
12. EU Consumer right of withdrawal (returns)

EU Consumers generally have a 14-day right of withdrawal from distance contracts, subject to applicable law.

The Customer must notify withdrawal within 14 days of receiving the Product and return it within 14 days of notification.

Return shipping costs are borne by the Customer unless the Seller states otherwise.

Refunds are made within the statutory period after receiving the returned Product or proof of dispatch where permitted by law.
13. Complaints and conformity

The Seller is liable for lack of conformity in accordance with mandatory consumer law.

Complaints should include order details, description of the issue and the Customer’s request.

The Seller will respond within 14 days.
14. Business Customers
Consumer-specific protections do not apply to Business Customers unless mandatory law provides otherwise. Liability towards Business Customers may be limited to the Order value, except for intentional damage, where legally permissible.
15. Intellectual property and no-copy policy
All Store Content, designs, graphics, product descriptions, branding elements and PRW identifiers are protected by copyright and unfair competition laws. Unauthorised copying or reuse is prohibited and may result in civil claims.
16. Fraud prevention and chargebacks
The Seller may investigate suspicious transactions and provide evidence to payment providers in disputes. Abusive chargebacks may result in restrictions on future purchases.
17. DSA notice-and-action (where user content exists)
Reports of potentially illegal content may be submitted to: shop@pureracingwear.com . The report should identify the content and include rationale and contact details.
18. Force majeure
The Seller shall not be liable for delays or failures caused by events beyond reasonable control (customs actions, strikes, carrier outages, natural disasters, etc.).
19. Governing law and dispute resolution
